3. User Accounts and Registration

To access certain features of our service, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account

4. Payment Terms

Our services are provided on a pay-per-qualified-lead basis. Payment terms include:

• Charges apply only to leads that meet your specified qualification criteria
• Billing occurs monthly in arrears for leads delivered in the previous month
• Payment is due within 30 days of invoice date
• Late payments may incur additional fees
• We reserve the right to suspend services for non-payment

5. Lead Quality Guarantee

We guarantee that all delivered leads meet your specified qualification criteria. If a lead does not meet these criteria:

• You may dispute the lead within 30 days of delivery
• We will investigate and provide a replacement lead or credit if the dispute is valid
• Our liability is limited to the cost of the disputed lead

6. Data Usage and Privacy

We collect and use data in accordance with our Privacy Policy. By using our services, you consent to:

• Our collection and use of data as described in our Privacy Policy
• The processing of prospect data for lead generation purposes
• The sharing of qualified lead information with you

7. Prohibited Uses

You agree not to use our services for:

• Any unlawful purpose or to solicit unlawful activity
• Spamming or sending unsolicited communications
• Violating any applicable laws or regulations
• Harassing, abusing, or harming others
• Impersonating any person or entity
• Collecting personal information without consent

8. Intellectual Property

The service and its original content, features, and functionality are owned by DevNexusX and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted service. We may:

• Perform maintenance that temporarily interrupts service
• Modify or discontinue features with reasonable notice
• Suspend service for technical or security reasons

10. Limitation of Liability

DevNexusX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.

11. Termination

Either party may terminate this agreement at any time with written notice. Upon termination:

• Your access to the service will be discontinued
• Outstanding invoices remain due and payable
• We will cease delivering new leads
• Data retention will follow our Privacy Policy

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or service notifications. Continued use of the service after changes constitutes acceptance of the new terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of El Paso County, Texas.
